These Terms of Service apply to the use of Whender Studios websites, WhenderOS and related services.
By using our services, you agree to these terms.
1. About Whender Studios
Whender Studios is a creative studio based in the Netherlands.
WhenderOS is software developed and operated by Whender Studios to support creative production, content management, publishing and related studio workflows.
2. Use of WhenderOS
You may use WhenderOS only for lawful purposes and in accordance with these Terms.
You are responsible for:
- maintaining control of your account;
- ensuring that information you provide is accurate;
- protecting your login credentials;
- ensuring that content you publish complies with applicable laws and platform rules;
- maintaining the necessary rights to content you upload or publish.
3. Facebook and Instagram integrations
WhenderOS may integrate with services provided by Meta Platforms, including Facebook and Instagram.
By connecting such an account, you authorize WhenderOS to perform the actions permitted by the permissions you grant.
These may include:
- retrieving connected account information;
- publishing content;
- checking publication status;
- retrieving analytics or insights.
Use of Facebook and Instagram is also governed by Meta’s own terms, policies and platform rules.
Whender Studios is not responsible for changes made by Meta to its APIs, availability, policies, algorithms or services.
4. Publishing
WhenderOS may allow you to prepare, schedule or publish content to third-party platforms.
You remain responsible for reviewing content before publication.
We cannot guarantee:
- that a third-party platform will accept a publication;
- that publication will occur at an exact time;
- uninterrupted availability of external APIs;
- the reach, visibility, engagement or distribution of published content.
Third-party platforms may process, delay, reject, restrict or remove content independently of Whender Studios.
5. Intellectual property
Unless otherwise stated, Whender Studios retains all rights in:
- Whender Studios branding;
- WhenderOS software;
- website design;
- proprietary workflows;
- original creative materials produced by Whender Studios.
You retain ownership of content that you own and upload to the service.
By using WhenderOS to process or publish content, you grant Whender Studios the limited rights necessary to technically process that content for the requested service.
6. Prohibited use
You may not use our services to:
- violate applicable law;
- infringe intellectual property rights;
- gain unauthorized access to systems or accounts;
- distribute malicious software;
- abuse or interfere with third-party services;
- misuse platform APIs;
- circumvent security or access controls.
7. Availability
We aim to keep our services reliable but do not guarantee uninterrupted or error-free operation.
Services may occasionally be unavailable due to:
- maintenance;
- software updates;
- infrastructure failures;
- third-party API outages;
- changes imposed by external service providers.
8. Third-party services
WhenderOS may depend on third-party services.
Those services operate under their own terms and policies.
Whender Studios is not responsible for the independent operation, availability or decisions of those third parties.
9. Limitation of liability
To the extent permitted by applicable law, Whender Studios is not liable for indirect or consequential losses resulting from the use or inability to use the service.
This includes losses resulting from:
- failed or delayed publication;
- third-party platform outages;
- changes in platform functionality;
- loss of social media reach or engagement;
- removal or restriction of content by third-party platforms.
Nothing in these Terms excludes liability that cannot legally be excluded.
